The Canadian Food Inspection Agency (CFIA) announced it will carry out a "complete depopulation" of hundreds of ostriches at a farm in British Columbia after the owners' attempt to appeal was denied by the Supreme Court of Canada.
The cull order was issued on December 31 following the discovery of an avian flu outbreak at Universal Ostrich Farms, located in Edgewood, B.C. The Supreme Court's refusal to hear the owners' final appeal eliminates any remaining legal obstacles to the cull, which had already been upheld by the Federal Court and the Federal Court of Appeal.
The CFIA stated it has “respected all orders of the courts and expects the ostrich farm owners and supporters to do the same now that the Supreme Court of Canada has issued its judgment.”
At the farm, supporters gathered in a prayer circle as co-owner Dave Bilinski shared the court's decision.
The Supreme Court’s refusal to hear the appeal clears the way for CFIA to begin depopulating the ostriches affected by the flu outbreak, ending a prolonged legal battle.
